TERMS & CONDITIONS FOR TUTORS

These Terms & Conditions (Hereinafter referred to as "Terms") govern the access to and use of the Success Beyond Struggle platform (Hereinafter referred to as "Platform") by tutors, educators, mentors, instructors, or any person providing teaching or educational services through the Platform (Hereinafter referred to as "Tutor").

By registering, accessing, subscribing to or using the Platform, the Tutor agrees to comply with and be legally bound by these Terms. If the Tutor does not agree with any part of these Terms, the Tutor shall discontinue use of the Platform immediately.

To register and provide services on the Platform, the Tutor must:

• Be at least 19 years of age
• Possess appropriate educational qualifications, subject knowledge, skills, or teaching expertise relevant to the subjects he/she is willing to teach
• Provide accurate, complete, and up-to-date information during registration and throughout the use of the Platform

The Platform reserves the right to:

• verify the authenticity of the Tutor's profile information and qualifications
• request supporting documents
• approve, reject, suspend, or remove any Tutor profile at its sole discretion

Tutors are responsible for maintaining accurate and updated profile information including:

• full name
• educational qualifications
• teaching experience
• subjects they wish to teach
• preferred teaching mode
• location and availability
• contact information
• and any other information requested by the Platform

The Tutor shall be solely responsible for the authenticity and accuracy of the information provided.

Submission of false, misleading, incomplete, or fraudulent information may result in:

• rejection of profile approval
• temporary suspension
• permanent removal from the Platform
• or legal action where applicable

Success Beyond Struggle is a subscription-based educational platform that connects students and parents with Tutors for online and offline learning services.

The Platform will:

• display Tutor profiles on the Platform and help connect them with students and parents seeking educational services
• recommend Tutors based on subject, location, availability, and student requirements
• facilitate communication between Tutors and students/parents
• determine or suggest standard fee structures for classes
• provide academic support and coordination services
• charge subscription fees, service fees, commissions, or other applicable charges.

For offline classes, the Platform may connect students with Tutors located in or around the student's preferred area based on availability and suitability.

The Platform acts primarily as a facilitator and coordination platform and does not guarantee confirmed class bookings, student enrollments, or fixed earnings.

Access to certain services or features of the Platform may require an active paid subscription.

Tutors acknowledge and agree that:

• subscription plans may vary from time to time
• access to student leads may depend upon the selected subscription plan
• subscriptions do not guarantee assurance that students will actually enrol for classes and fixed earnings
• subscriptions are generally non-transferable and non-refundable unless expressly stated otherwise.

The Platform reserves the right to:

• modify subscription plans or pricing
• restrict or discontinue certain features
• suspend services in case of non-payment
• or discontinue any subscription plan at its discretion.

The Platform may charge:

• subscription fees
• lead-access charges
• service fees
• promotional charges
• convenience fees
• commissions
• or other applicable charges

Class fees or pricing structures may be:

• determined by the Platform
• mutually communicated through the Platform
• or revised from time to time depending upon subject, level, location, teaching format, or subscription category

Tutors agree:

• to comply with Platform pricing policies where applicable
• not to manipulate or misrepresent pricing structures
• and to pay all applicable fees within the prescribed timelines

Failure to comply with payment obligations may result in:

• restricted access
• reduced visibility
• withholding of leads
• suspension
• or termination of services

The Tutor agrees to:

• conduct classes professionally, ethically, and responsibly
• provide educational services sincerely and diligently
• maintain respectful communication with students, parents, and Platform representatives
• respond to inquiries within a reasonable time
• maintain confidentiality of student information
• ensure a safe, respectful, and comfortable learning environment
• comply with all the laws applicable in India and Platform rules, policies and guidelines
• avoid conduct that may damage the reputation or operations of the Platform

Tutors shall not engage in:

• harassment
• abusive or discriminatory behaviour
• intimidation
• inappropriate communication
• or unlawful conduct while interacting with students, parents, or other users

Tutoring services may be conducted:

• online through digital platforms
• offline at mutually agreed locations
• or through hybrid arrangements

Tutors are solely responsible for:

• maintaining professionalism during classes
• ensuring lawful and appropriate conduct
• maintaining student safety and comfort during offline sessions
• managing transportation or location-related arrangements where applicable

The Platform shall not be responsible for:

• physical safety incidents
• transportation issues
• location-related disputes
• personal interactions occurring outside Platform supervision
• or arrangements independently made between Tutors and students/parents

Tutors are expected to make genuine and reasonable efforts toward student learning and academic improvement.

The Tutor may be required to:

• participate in follow-up discussions or check-in calls with the Platform
• provide general feedback regarding student progress
• communicate concerns affecting the student's learning experience

If a student:

• is unable to cope academically
• demonstrates continuous lack of progress
• faces learning difficulties
• or presents behavioural concerns affecting classes

the Tutor is encouraged to inform the Platform within a reasonable time so that appropriate support or guidance may be provided.

The Platform does not guarantee academic outcomes and acknowledges that student performance depends upon multiple factors beyond the Tutor's control.

Student and parent leads provided by the Platform shall be used solely for educational and tutoring-related purposes only.

The Tutor shall not:

• misuse student contact information
• share leads with third parties
• use leads for unrelated marketing or promotional purposes
• engage in spam, harassment, or unsolicited communication.

The Platform may provide student inquiries or contact opportunities to Tutors. However, the Platform does not guarantee that such inquiries will result in confirmed classes, paid students, or income opportunities.

Tutors shall not intentionally bypass or circumvent the Platform to directly solicit, divert, or continue tutoring arrangements with students introduced through the Platform for the purpose of avoiding Platform fees, commissions, or service charges.

Any attempt to circumvent the Platform may result in:

• suspension of account
• permanent removal from the Platform
• restriction of services
• or legal action where applicable.

Students and parents may submit complaints, reviews, or feedback regarding Tutors.

The Platform reserves the right to:

• review complaints
• conduct inquiries and investigations
• request clarification from the Tutor
• review and remove ratings or feedback that violate Platform policies or contain false, abusive, misleading, or inappropriate content
• and take appropriate action where necessary

Depending upon the nature, severity, or frequency of complaints, the Platform may:

• issue warnings
• reduce profile visibility
• temporarily suspend the account
• permanently remove the Tutor from the Platform

Tutors agree to cooperate reasonably during investigations or review processes.

The Platform's decisions regarding moderation, suspension, or account actions shall be final and binding.

The Platform may collect, display, modify, remove, or internally evaluate ratings and reviews relating to Tutors.

Tutor performance may be assessed based on factors including:

• student feedback
• complaint history
• responsiveness
• professionalism
• consistency
• class conduct
• and overall user experience

The Platform reserves the right to determine how ratings, reviews, or performance indicators are displayed on the Platform.

Tutors shall not:

• provide false, misleading, or fraudulent information
• impersonate another person or entity
• misuse confidential student information
• violate applicable laws or third-party rights
• upload unlawful, offensive, abusive, or harmful content
• attempt to disrupt Platform operations or security
• engage in unethical, discriminatory, or inappropriate conduct
• damage the reputation or goodwill of the Platform

Any violation may result in immediate suspension or termination without prior notice.

All Platform content including:

• logos
• branding
• website design
• graphics
• software
• text
• documents
• and other materials

are the exclusive property of Success Beyond Struggle unless otherwise stated.

Tutors shall not copy, reproduce, distribute, modify, or commercially exploit any part of the Platform without prior written permission.

The Platform reserves the right to suspend, restrict, or terminate a Tutor account in the event of circumstances including but not limited to:

• violation of these Terms and Conditions
• misconduct, unethical, inappropriate, or unlawful behaviour
• repeated or serious complaints from students, parents, or users
• fraudulent, misleading, or deceptive activities
• misuse of the Platform, its services, or user information
• persistent poor conduct or unsatisfactory professional behaviour
• non-payment of applicable subscription fees or charges
• activities that may adversely affect the reputation, operations, safety, or interests of the Platform or its users

Except in cases requiring immediate action for safety, security, legal compliance, or protection of users or the Platform, the Tutor shall ordinarily be informed of the concerns or alleged violations and may be provided a reasonable opportunity to respond, clarify, or rectify the issue within such time as may be determined by the Platform.

After considering the relevant circumstances and the Tutor's response, if any, the Platform may take appropriate action, including suspension, restriction, or termination of the Tutor account.

Suspension or termination may result in:

• removal or limitation of profile visibility
• restriction or loss of access to Platform services or features
• temporary or permanent deactivation of the Tutor account

The decision of the Platform regarding suspension or termination shall be final and binding, subject to applicable law.

The Platform shall not be liable for any indirect or consequential loss arising from such suspension, restriction, or termination carried out in accordance with these Terms and Conditions.

Tutors using the Platform act as independent service providers and not as employees, partners, agents, representatives, or affiliates of the Platform.

Nothing contained in these Terms shall create:

• an employer-employee relationship
• partnership
• joint venture
• agency
• franchise
• or fiduciary relationship between the Platform and Tutors.

Tutors shall remain solely responsible for:

• their teaching services
• tax obligations
• professional conduct
• and compliance with applicable laws

Success Beyond Struggle acts primarily as a platform that connects Tutors with students and parents for educational services.

The Platform may, wherever reasonably possible, assist in addressing concerns, facilitating communication, and helping resolve issues that arise between Tutors, students, and parents. However, the Platform is not a party to the tutoring arrangement and cannot guarantee the actions, conduct, or performance of any User.

Except where required by applicable law, the Platform shall not be held responsible or liable for:

• personal arrangements or agreements made outside the Platform
• academic results, examination performance, or educational outcomes
• cancellation, postponement, or interruption of classes by any party
• misconduct, misrepresentation, or breach of obligations by students, parents, or Tutors
• disputes relating to fees, schedules, attendance, or teaching methods
• loss of income, profits, business opportunities, or reputation
• technical interruptions, system failures, or temporary unavailability of the Platform
• indirect, incidental, special, or consequential damages

If any complaint, dispute, or issue arises in relation to tutoring services arranged through the Platform, the Platform may review the matter, communicate with the concerned parties, and take appropriate action in accordance with these Terms. Any such assistance provided by the Platform shall not be treated as an acceptance of legal responsibility or liability.

Tutors are encouraged to inform the Platform about any safety concerns, misconduct, disputes, or other issues (if any) as soon as possible so that appropriate support or action could be taken.

Tutors and students are expected to exercise reasonable care, professionalism, and good judgment during online and offline interactions.

Tutor information may be collected, stored, processed, used, and displayed by the Platform for purposes including but not limited to:

• creation and management of Tutor profiles
• matching Tutors with students or educational requirements
• facilitating communication between users and the Platform
• improving and optimizing Platform services and user experience
• conducting analytics, monitoring, and operational assessments
• and carrying out lawful business and administrative operations of the Platform

By registering on or using the Platform, Tutors expressly consent to the collection, use, storage, and processing of their information in accordance with the Platform's Privacy Policy.

Tutors shall also maintain strict confidentiality of any student, parent, or user information accessed through the Platform and shall not disclose, misuse, or share such information except as permitted under these Terms and Conditions or applicable law.

The Platform reserves the right to amend, modify, update, or revise these Terms and Conditions at any time, at its sole discretion.

Any such modifications shall become effective upon being published or updated on the Platform, unless otherwise expressly stated.

Continued access to or use of the Platform after such modifications shall constitute the Tutor's acknowledgment and acceptance of the revised Terms and Conditions.

Tutors are advised to review these Terms periodically to remain informed of any updates or changes.

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising out of or relating to these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located at [Place].
