TERMS & CONDITIONS FOR STUDENTS / PARENTS

These Terms & Conditions (Hereinafter referred to as "Terms") govern the access to and use of the Success Beyond Struggle platform (Hereinafter referred to as "Platform") by students, parents, guardians, or any other users seeking educational services through the Platform (Hereinafter referred to as "Users").

By accessing, registering on, or using the Platform, the Users agree to be bound by these Terms and Conditions.

The Platform primarily serves as a medium to connect students, parents, and guardians with Tutors and provide services such as tutor matching, tutoring-related assistance, user support, and coordination services. The Platform facilitates such connections but does not itself provide teaching services, conduct classes, or employ Tutors.

• Any individual capable of entering into a legally binding agreement may use the Platform.
• Users below the age of 18 years should access and use the Platform under the supervision of a parent or legal guardian.
• Users agree to provide accurate, complete, and up-to-date information while registering and using the Platform.
• Users shall be responsible for maintaining the accuracy of their account information and promptly updating any changes.

The Platform provides services designed to help students and parents connect with suitable Tutors and receive educational assistance, including:

• helping students and parents find Tutors based on their educational requirements
• providing access to Tutor profiles, qualifications, experience, and other relevant information
• assisting students and parents in selecting suitable Tutors
• offering support for resolving tutoring-related queries or concerns
• facilitating educational counselling and other learning-related support services

The Platform shall make reasonable efforts to assist students and parents in finding Tutors tutoring-related assistance, user support, and coordination services. However, the Platform does not guarantee:

• Specific academic results
• Examination scores or rankings
• Admission outcomes
• Employment opportunities
• Tutor availability at all times
• Continuous availability of any particular Tutor

Users may be required to provide personal, academic, and contact information to access certain services.

Users are responsible for ensuring that all information provided to the Platform, including personal contact, and academic information, is accurate, truthful, complete, and kept up to date at all times.

The Platform reserves the right to verify information provided by Users and may suspend or restrict access where information is found to be false, misleading, incomplete, or fraudulent.

Users agree to:

• Provide accurate academic requirements, expectations, and relevant information
• Communicate respectfully and professionally with Tutors and Platform representatives
• Attend scheduled classes punctually and regularly
• Participate actively and sincerely in the learning process
• Complete assignments, exercises, or academic tasks where applicable
• Follow educational guidance and recommendations reasonably provided by Tutors
• Comply with applicable laws and Platform policies
• Maintain respectful conduct at all times while using the Platform.

Users shall not engage in:

• Harassment
• Abusive or discriminatory behaviour
• Threatening or intimidating conduct
• Inappropriate communication
• Fraudulent activities
• Any conduct that may adversely affect Tutors, other Users, or the Platform.

The User acknowledges that academic improvement depends upon various factors including student effort, consistency, learning ability, attendance, study habits, and efforts made by the Tutor.

The Platform may recommend, display, or suggest suitable Tutors based on available information and educational requirements.

However:

• The final selection of any Tutor remains solely the responsibility of the User
• The User is free to evaluate and choose a Tutor based on their own judgment
• Unless expressly stated otherwise by the Platform, decisions relating to class schedules, teaching methodology and the duration of teaching services shall be mutually determined between the Tutor and the User.

The Platform does not guarantee compatibility between any Tutor and User.

The Platform may charge subscription fees, service fees, consultation fees, premium membership charges, Tutor fees, or other applicable fees for services offered through the Platform.

The User agrees that:

• all applicable payments shall be made through the Platform using the available payment methods
• Users shall be responsible for ensuring timely payment of applicable fees
• fees paid through the Platform shall be deemed authorized by the User unless reported otherwise without undue delay
• Users shall carefully review payment details before completing any transaction

Refunds shall not be granted as a matter of right. However, the Platform may consider refund requests on a case-to-case basis.

The Platform reserves the right to approve, partially approve, or reject any refund request after reviewing the circumstances. Any decision regarding a refund shall be communicated to the User and shall be final, subject to applicable law.

Users may raise complaints regarding:

• Tutor behaviour
• Teaching quality
• concerns relating to communication, responsiveness, or coordination with a Tutor
• Professional misconduct
• Any other concern relating to classes or services provided through the Platform.

Upon receiving a complaint, the Platform may:

• Review the complaint and the information provided
• Seek clarification or additional information from the User, Tutor, or any other relevant person
• Conduct reasonable inquiries into the matter
• Recommend appropriate corrective measures
• Suggest a replacement Tutor where considered appropriate
• Take suitable action in accordance with these Terms and Conditions.

Users shall ensure that all complaints, allegations, and feedback submitted to the Platform are truthful, accurate, and made in good faith.

The submission of knowingly false, malicious, misleading, or frivolous complaints may result in restriction, suspension, or termination of the User's access to the Platform.

Users are encouraged to provide honest, fair, and accurate feedback regarding Tutors and Platform services.

Feedback may be used for:

• improving Platform services
• evaluating Tutor performance
• maintaining and improving the quality of services offered through the Platform
• handling complaints, resolving disputes, and managing Platform services.

The Platform reserves the right to review, remove, edit, or decline publication of any feedback, rating, or review that is false, misleading, defamatory, abusive, discriminatory, unlawful, spam-related, or otherwise inconsistent with Platform policies.

Users shall not:

• Engage in abusive, threatening, discriminatory, unlawful, or inappropriate behaviour
• Harass, intimidate, threaten, or defame Tutors, other Users, or Platform representatives
• Misuse Tutor contact details, personal information, or educational materials
• Impersonate another person or provide false information
• Attempt to interfere with the operation, security, or functionality of the Platform
• Use the Platform for fraudulent, deceptive, or unauthorized purposes
• Engage in any activity that may harm the reputation, operations, or interests of the Platform or its users.

Tutor contact information shared through the Platform shall be used solely for educational and tutoring-related purposes.

The Platform may facilitate connections between Users and Tutors for online or offline educational services.

The User acknowledges and agrees that:

• The Platform is not physically present during offline classes or in-person interactions
• Decisions regarding the location, timing, and conduct of offline classes are made independently by the Tutor and the User
• Users and Tutors are responsible for maintaining a safe, respectful, and appropriate learning environment during offline sessions
• Parents or guardians of minor students shall be responsible for ensuring appropriate supervision and safety arrangements where necessary.

The Platform shall not be liable for any injury, accident, dispute, loss, theft, damage, misconduct, or other incident arising out of offline classes or in-person interactions between Tutors and Users.

However, if a User has concerns regarding a Tutor's conduct, behaviour, professionalism, or violation of these Terms and Conditions, the User may report the matter to the Platform. Upon receiving such a complaint, the Platform may review the matter, seek relevant information from the parties involved, and take appropriate action in accordance with its policies and these Terms and Conditions.

The Platform may collect and use information provided by Users, such as their name, contact details, educational requirements, and other relevant information, for purposes including:

• helping Users connect with suitable Tutors
• facilitating communication between Users and Tutors
• providing and managing Platform services
• improving the quality and user experience of the Platform
• addressing complaints, resolving disputes, and providing customer support
• maintaining records and carrying out Platform operations
• complying with applicable legal and regulatory requirements

By using the Platform, Users agree to the collection, use, storage, and processing of their information in accordance with the Platform's Privacy Policy.

The Platform takes reasonable steps to protect User information from unauthorized access, misuse, or disclosure. However, while the Platform strives to maintain the security of its systems, no method of electronic storage or transmission can be guaranteed to be completely secure.

Educational materials, notes, worksheets, presentations, assignments, recordings, study resources, and other content provided by Tutors or the Platform shall remain the intellectual property of their respective owners unless otherwise agreed.

Users shall not:

• Copy, reproduce, distribute, publish, modify, sell, or commercially exploit educational materials without proper authorization
• Claim ownership over materials provided by Tutors or the Platform
• Use educational content for commercial purposes without prior written consent.

Where applicable, Users shall not record, reproduce, publish, distribute, or share classes, educational sessions, or related content without the consent of the Tutor and, where required, the Platform.

The Platform reserves the right to suspend, restrict, or terminate a User account in circumstances including but not limited to:

• Violation of these Terms and Conditions
• Fraudulent, deceptive, or unlawful activities
• Repeated misconduct or inappropriate behaviour
• Submission of false information
• Abuse of Tutors, Platform representatives, or other Users
• Non-payment of applicable fees
• Activities that may adversely affect the Platform, its users, or its operations.

Except where immediate action is necessary for safety, security, legal compliance, or protection of users or the Platform, the User shall ordinarily be informed of the concerns or alleged violations and may be provided a reasonable opportunity to respond or clarify the matter.

After considering the relevant circumstances and the User's response, if any, the Platform may take appropriate action including suspension, restriction, or termination of access.

Suspension or termination may result in:

• Restriction or loss of access to Platform services
• Removal of account privileges
• Temporary or permanent deactivation of the account.

The Platform's decision regarding suspension or termination shall be final, subject to applicable law.

The Platform functions primarily as an intermediary and facilitator connecting Users with Tutors.

While the Platform makes reasonable efforts to maintain the quality of its services and address concerns raised by Users, it does not control or supervise every class, educational interaction, or arrangement between Tutors and Users.

Accordingly, the Platform does not guarantee:

• academic improvement, examination results, admissions, certifications, or other specific educational outcomes
• the suitability of a particular Tutor for a User's individual needs or expectations
• uninterrupted availability of any Tutor, class, or service

The Platform shall not be liable for:

• disagreements or disputes arising directly between Tutors and Users
• cancellation, postponement, or discontinuation of classes by either party
• the conduct, actions, or omissions of Tutors, students, parents, or other users
• injury, accidents, theft, loss, damage, or other incidents occurring during offline classes or in-person interactions.

Nothing in these Terms prevents Users from reporting concerns or complaints regarding a Tutor to the Platform. The Platform may review such complaints and take appropriate action in accordance with its policies and these Terms and Conditions.

Users are encouraged to exercise reasonable judgment while selecting and engaging with Tutors through the Platform.

The Platform reserves the right to amend, modify, update, or revise these Terms and Conditions at any time, at its sole discretion.

Any such modifications shall become effective upon publication on the Platform unless otherwise expressly stated.

Continued access to or use of the Platform following such modifications shall constitute the User's acknowledgment and acceptance of the revised Terms and Conditions.

Users are advised to review these Terms periodically to remain informed of any updates.

These Terms and Conditions shall be governed by, construed, and interpreted in accordance with the laws for the time being in force in India.

Any disputes arising out of or relating to these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located at [Place].
